Please ensure you read the below Terms & Conditions, this will ensure you get the most out of your visit.
When you are touring with The Native Tourguide we want you to enjoy your time exploring the Isle of Man.
We prepare and train hard to provide you with a quality experience.
In the FAQs section of our website www.thenativetourguide.com you will find guidance about our guided walks and tours, but if anything is unclear, please contact us directly using the online contact form, e-mail, Facebook messenger or whatsapp.
Please read through these sections of the website before enquiring about the availability of places. Before booking you will be asked to confirm you have read the description, accepted these terms and conditions you will also be asked to complete a registration form.
This registration form includes information about special requirements, allergies, injuries and medical conditions.
Covid 19, if you have any of these symptoms or develop them between booking and the event, please contact us and withdraw from the activity.
Whilst on The Native Tourguide tours, you will be accompanied at all times by a qualified walking guide trained and assessed by the Guild of Manx Registered Tour Guides as an Isle of Man Blue Badge Guide.
Please follow the guidance and instructions of your guide at all times. Your guide is First Aid qualified and carries a first aid kit. The Native Tourguide holds public liability insurance and a copy of our certificate and policy are available on request.
BOOKING AND PAYMENTS
Advance booking is essential. Please check with us that places are available for your selected event. On confirmation of this the event may be booked.
For all tours, full payment is due at the time of booking.
For bespoke events, corporate bookings and guided tours an advance payment of 50% is payable on booking (or 6 weeks in advance of the event at the latest) with the balance due one week prior to the event.
A booking should not be considered as definite until confirmation has been received from us following payment.
BAD WEATHER CONDITIONS
The Native Tourguide will walk in all types of weather unless it is considered by the guide to be unsafe. We reserve the right to change the itinerary or walking routes for safety reasons in poor weather conditions. In very extreme circumstances it may be necessary to cancel an event, in which case you will be able to transfer to an equivalent event or receive a full refund. No refunds will be made if you decide not to walk due to weather conditions.
PARENTAL, LEGAL GUARDIAN and RESPONSIBLE ADULT RESPONSIBILITY
For our guided walks and cycle tours there are no minimum age restrictions provided under 18s are accompanied by a parent, legal guardian or responsible adult and the participants are fit and able to do the activity chosen. Children under the age of 13 are only accepted by prior agreement on our group tours. For all activities the parent, legal guardian or responsible adult must take full responsibility for and supervise under 18s at all times.
RIGHTS OF ADMISSION
The Native Tourguide reserves the right to refuse a booking for participating in our walks, if in our reasonable opinion participation is likely to cause distress, annoyance or damage to themselves, other participants, or to our activity leaders. This includes participants who fail to advise us of a medical condition or disability which prevents their full participation in the walks, and participants whom we believe may be under the influence of alcohol or drugs. It also includes participants who, in the opinion of the walk leader, are not properly clothed or equipped to enjoy the walk in safety. We are not responsible for any inconvenience or costs incurred as a result.
DOGS AND OTHER PETS
We do not accept dogs or other pets on our group walks and activities unless we have agreed to this by prior arrangement and the other participants are comfortable with this.
Some routes we use on the Isle of Man exclude dogs at the requirement of the landowner; others may go through livestock. Please get in touch in advance if you wish to bring a pet.
WEBSITE ACCURACY
We believe that this website is accurate. We reserve the right to make changes and update details in it.
COMPLAINTS If you have a complaint about your tour please notify your organiser on the day and they will do their best to resolve the problem. Should it not be possible to resolve the issue at that time, you should put your complaint :

or by e-mail to Thenativetourguide@gmail.com no later than 28 days after your event.
Complaints will be acknowledged within 14 days. All complaints will be thoroughly investigated, and you will be kept informed throughout the process.
REFUND, TRANSFER and CANCELLATION TO CHANGE YOUR BOOKING If you wish to transfer your booking to another date once it has been paid for and confirmed we will make every effort to accommodate your wishes so long as we receive written or e-mailed confirmation from the person that made the booking. We cannot guarantee however that we will be able to meet your needs.
TO CANCEL YOUR BOOKING
If you or any member of your party needs to cancel the booking of a Guided walk or Skills course, this should be done in writing or by e-mail by the person who made the booking. If you cancel more than 7 days ahead of the walk or event that you have booked, we will offer you the opportunity to re-book for a walk of the same value on an alternative day over the following 12 months for no additional charge. In exceptional circumstances beyond your control we may be able to offer a full refund. If you cancel 7 days or less in advance of the walk or event that you have booked, we will be unable to refund the money that you have paid.
IF THE NATIVE TOURGUIDE NEEDS TO CANCEL YOUR BOOKING
In the unlikely event The Native Tourguide has to cancel your booking, you will be offered either a transfer to another event of the same or higher value or a full refund of money paid. We will not be liable for any additional costs or expenses incurred as a result of this. We usually only cancel walks and events if we consider it would be unsafe due to extreme weather conditions.
GENERAL GUIDANCE
It is at the walk leader’s/guide’s discretion to change the route of a walk should the weather conditions, or other extraneous circumstances, deem it necessary to change a route. Walk leaders/guides may refuse to accept participants who in their opinion are inadequately equipped or not able to complete the chosen route.
Changes may be made to advertised walks at short notice, please ensure you keep upto date with any changes through our social media and website.
COVID-19
If you are experiencing any of the COVID-19 symptoms listed below or have been in contact with someone who is displaying these symptoms, please declare this and withdraw from the activity:
• a temperature of more than 37.8C (100F)
• OR, a new and persistent cough - this means coughing a lot for more than an hour, or 3 or more coughing episodes in 24 hours (if you usually have a cough, it may be worse than usual)
• OR, anosmia – this is the loss of or a change in your normal sense of smell. It can also affect your sense of taste as the two are closely linked
• OR, a new shortness of breath

Your Data
The Native Tourguide offers guided walks and cycling tours on the Isle of Man. The Native Tourguide is owned by Janine Shimmin and operated as a sole trader business registered on the Isle of Man. Janine Shimmin is the Data Controller and Processor of the personal information that participants provide to The Native Tourguide via the website, e-mail correspondence and on Registration Forms. When The Native Tourguide collects your personal information, we will: • only collect what we need and no more • keep your information secure • tell you how we will use your information • delete your information when it is no longer needed • only process your information in line with, details rules set out in the Data Protection Act 2018 Personal Information.
When making a payment transaction for a tour, we will require the following information to be entered into Google Pay or associated by correspondence with a bank transfer: • First & last name • Billing Address & Delivery Address • Contact details, including email address and phone numbers Your card details are processed securely by a third-party payment provider (Google Pay). We do not have access to this information. Please see Google Pay’s Privacy Policy https://www.paypal.com/uk/webapps/mpp/ua/privacy-prev Once payment has been made, we will send you a Confirmation Email and a Registration Form, which constitutes the contract between us. Additional personal information may be required for each participant attending a guided walk or a cycling tour, to be entered onto the Registration Form, either digitally or printed: • Name, contact details and home address of each participant • Local accommodation address and contact details if different from the above • Emergency contact name and phone number • Current fitness information 2 • Walking, Cycling experience • Medical information, allergies, recent illnesses or special requirements (special category of personal data). This includes information about COVID-19 or symptoms of COVID-19.
Why we need your personal information (contract of service)
We process your personal information in order for us to enter into a contract with you and provide you with your chosen activity. The reasons are as follows: • To enter into a contract, you need to provide payment and personal details so we can send you detailed information about your chosen activity, including the Confirmation e-mail and Registration Form (which form the contract). • We need to know who is attending our tours so we can provide a safe and enjoyable experience for you. This means that we require personal details, emergency contact and health information to be completed and returned to us on the Registration Form. This also allows us to respond to and communicate with participants regarding questions, comments, support needs, complaints or concerns in relation to our tours. We may also send you feedback emails and photographs after the event. • To comply with legal requirements for our own insurance and tax purposes. • To meet the requirement of Isle of Man Public Health to maintain details of participants following activities as and when this is mandated. You have the right to object to us using your personal information in certain circumstances. If you wish to object to any of the above processing, please contact us on Thenativetourguide@gmail.com If we agree and comply with your objection, this may affect our ability to enter into a contract with you or provide you with our services.
Marketing (consent) If you would like to receive e-mail marketing communications from us, we will ask you to opt-in when we meet you on or following the guided tour. You will simply need to sign an opt-in form, to give The Native Tourguide consent to send you marketing emails. You may change your preferences at any time or request that we stop sending you e-mail marketing communications by sending an Email to Thenativetourguide@gmail.com
Who we share your personal information with. We may be required to share personal information with statutory or regulatory authorities and organisations to comply with statutory obligations. Such organisations include the Health & Safety at Work Inspectorate, the Isle of Man Constabulary and the Isle of Man Safeguarding Board for the purposes of safeguarding children and vulnerable adults. We may share personal information with Isle of Man Public Health to allow contact tracing if this is deemed necessary by them. We may also share personal information with our insurers as well as our professional and legal advisors for the purposes of seeking advice, legal counsel or in the event of an insurance claim against us. We may share a ‘summary’ of your personal information (name, emergency contact, walking experience, medical information) to walk leaders, walk supporters and instructors who are assisting Janine Shimmin with a tour where group numbers require more than one leader. This information will be in printed format only and given to the walk support and then collected by Janine Shimmin as Data Controller at the end of the tour. In the event that we do share personal information with external third parties, we will only share such personal information strictly required for the specific purposes and take reasonable steps to ensure that recipients shall only process the disclosed personal information in accordance with those purposes. We only share personal information with Third Parties where it is legally required or is essential for us to fulfil our contract with you.
How we protect your personal information When you visit our website www.Thenativetourguide.com you do so through secure servers (SSL). The use of Secure Socket Layer (SSL) means that all personal information is transmitted securely over the internet. Your personal information is then stored within the Google Pay system (with two factor authentication), Janine Shimmin’s computer (password protected) and may also be printed onto forms in tour folders.
We do NOT have access to your credit card or debit card details.
How long we keep your personal information We will keep your personal information for 7 years (financial information and the contract between us) to comply with our legal requirements for insurance and tax purposes. After 7 years, this personal information will either be deleted (digital) or shredded (paper). Within that period personal information will also be kept for two months to enable Isle of Man Environmental Health to use it for contact tracing if required.
Your rights You can exercise any of the following rights by writing to us at Thenativetourguide@gmail.com Your rights in relation to your personal information are: • you have a right to request access to the personal information that we hold about you by making a “subject access request”; • if you believe that any of your personal information is inaccurate or incomplete, you have a right to request that we correct or complete your personal information; • you have a right to request that we restrict the processing of your personal information for specific purposes; and • if you wish us to delete your personal information, you may request that we do so. Any requests received by The Native Tourguide will be considered under applicable data protection legislation and we will need to check your identity before taking any action. It may not be possible to delete all of your personal information before 7 years have elapsed from the time you made the booking for, or attended a tour, since we are legally required to keep good financial records for tax purposes. We will reply within 30 days. If you are not satisfied with The Native Tourguides’ processing of your personal data, you should notify Janine Shimmin via Thenativetourguide@gmail.com . If you are still dissatisfied, you may complain to the Isle of Man Information Commissioner via www.inforights.im.
